Last updated: September 14, 2026
1. About These Terms
These Terms & Conditions apply to your use of www.zenwithmaral.com and to purchases of products from Zen With Maral.
By using our website, creating an account, or placing an order, you agree to these Terms & Conditions.
Zen With Maral operates from Auckland, New Zealand.
Website: https://www.zenwithmaral.com Contact: contact@zenwithmaral.com
Nothing in these Terms limits any rights or remedies you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other New Zealand law that cannot lawfully be excluded.
2. Our Website
We aim to keep the information on our website accurate and up to date.
We may update, change, suspend or remove website content, products, features or services from time to time.
We do not guarantee that the website will always be available without interruption, delay or technical error.
We may temporarily restrict access where reasonably necessary for maintenance, security, technical issues or updates.
3. Products
We aim to describe and display our products as accurately as reasonably possible.
Product photographs, colours and appearance may vary slightly depending on lighting, photography, screen settings and the handmade or natural characteristics of a product.
Where relevant, variations in handmade, floral, scented or decorative products may occur and do not necessarily mean that a product is faulty.
Any important product characteristics, dimensions, materials or options should be checked before you place your order.
Your rights under the Consumer Guarantees Act are not affected by reasonable product variations.
4. Product Availability
All products are subject to availability.
Stock information displayed on the website is intended to reflect current availability, but in rare circumstances an item may become unavailable after an order is placed.
If we cannot supply an item you have paid for, we will contact you and provide an appropriate remedy, such as a refund, replacement or alternative where agreed with you.
We may limit quantities where reasonably necessary, including to prevent fraud, stock errors or misuse of the website.
5. Prices
Unless otherwise stated, prices displayed on the website are in New Zealand dollars (NZD).
Any GST or other applicable tax will be treated as displayed or required by law.
Shipping or delivery charges, where applicable, are shown before payment is completed.
We may change prices at any time before an order is placed.
Once an order has been accepted and paid for, we will not change the agreed price except where required to correct an obvious error and where doing so is permitted by law.
If a genuine pricing error occurs, we will contact you before fulfilling the affected order where reasonably possible.
6. Orders
Placing an order through the website is an offer to purchase the selected products.
An order is not finally accepted merely because you submit the checkout form.
We may decline or cancel an order before fulfilment where reasonably necessary, including where:
- a product is unavailable
- there is an obvious pricing or listing error
- payment cannot be completed or verified
- we reasonably suspect fraud or misuse
- shipping or fulfilment is not reasonably possible
If we cancel an order after payment has been successfully received and no lawful amount remains payable, we will provide an appropriate refund.
We will not cancel an order for an unlawful or discriminatory reason.
7. Payment
Payments are processed securely through our payment provider.
Zen With Maral does not store your complete payment-card number or card security code.
You must provide accurate payment and billing information.
An order may not be fulfilled until the required payment has been successfully completed.
If a payment is reversed, disputed or found to be fraudulent, we may pause fulfilment while the issue is reasonably investigated.
8. Order Confirmation
After successful checkout, you may receive an order confirmation by email.
Please check your order details and contact us promptly if something appears incorrect.
An email being delayed or not received does not by itself mean that a valid paid order has been cancelled.
Our payment and order records will be used to determine the status of an order.
9. Shipping and Delivery
Shipping and delivery are subject to our Shipping Policy.
The Shipping Policy forms part of these Terms & Conditions.
Delivery estimates are estimates unless we expressly agree otherwise.
We will take reasonable care in arranging delivery and will comply with our obligations under New Zealand consumer law.
You are responsible for providing an accurate and reasonably accessible delivery address.
If incorrect or incomplete information supplied by you causes additional delivery costs or delays, we may ask you to pay reasonable additional costs before re-delivery.
This does not affect your rights where the problem was caused by us or by a party for whom we are legally responsible.
10. Risk and Delivery
Responsibility for goods will transfer in accordance with applicable New Zealand law.
We remain responsible for meeting our legal obligations relating to delivery, including where the Consumer Guarantees Act applies.
If an order appears lost, damaged or incorrectly delivered, please contact us so we can investigate and provide any remedy required by law.
11. Returns, Faults and Refunds
Returns and return requests are subject to our Returns Policy.
Our Returns Policy does not limit your rights under the Consumer Guarantees Act.
If a product does not meet a guarantee required by New Zealand consumer law, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
We are not required to provide a refund solely because you changed your mind unless our Returns Policy expressly allows one.
Please contact us if you believe a product is faulty, damaged, incorrectly supplied or not as described.
12. Promotions and Discounts
From time to time we may offer promotions, discount codes, special pricing or limited offers.
Additional conditions may apply to a promotion and will be displayed with the offer where relevant.
Unless otherwise stated:
- promotions cannot be exchanged for cash
- promotional codes must be used before their expiry date
- only one promotional code may be used per order where the website restricts combinations
- discounts cannot be applied retrospectively to an already completed order
We may withdraw or correct a promotion where there is a genuine error, fraud, misuse or technical problem.
We will not use promotional terms in a way that unlawfully removes consumer rights.
13. Accounts
You may be able to create a customer account on our website.
You are responsible for:
- providing accurate information
- keeping your login details secure
- notifying us if you believe your account has been accessed without permission
You must not use another person's account without permission.
We may temporarily restrict an account where reasonably necessary to protect the customer, our business or the website from suspected fraud, abuse or security threats.
14. Acceptable Use
You must not intentionally:
- interfere with the operation or security of the website
- attempt to gain unauthorised access to accounts, systems or data
- introduce malicious software
- use automated tools in a way that places an unreasonable burden on the website
- commit fraud or provide deliberately false information
- use the website for unlawful purposes
We may restrict access where reasonably necessary to prevent or respond to misuse.
15. Intellectual Property
Unless otherwise stated, the website and its original content, including branding, text, graphics, designs, photographs and other materials created for Zen With Maral, are owned by or licensed to Zen With Maral.
You may use the website for personal and ordinary business browsing and purchasing purposes.
You must not reproduce, publish, sell, distribute or commercially exploit our protected content without permission unless permitted by law.
Third-party names, trademarks or materials remain the property of their respective owners.
16. Third-Party Services
Our website may rely on or link to third-party services, including payment, hosting, delivery and other technology providers.
We are not responsible for independent third-party websites or services that are outside our reasonable control.
However, nothing in this section removes responsibility that New Zealand law places on Zen With Maral in relation to products or services supplied by us.
17. Property Staging, Photography and Other Services
Property staging, property photography and related professional services may be subject to:
- a specific quote or proposal
- our Service Terms
- any additional terms clearly agreed with you in writing
Where you accept a service quote, the Service Terms version and terms snapshot associated with that quote apply to that service.
If there is a conflict between these general website Terms and specific terms expressly agreed for a service, the specific service or quote terms will apply to that service to the extent of the conflict, subject to applicable law.
18. Consumer Rights
Nothing in these Terms is intended to exclude, restrict or modify a right or remedy that cannot lawfully be excluded under New Zealand law.
For consumers, this includes applicable rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
Products supplied to consumers must meet applicable legal guarantees, including guarantees relating to acceptable quality, fitness for purpose and correspondence with description.
Services supplied to consumers must meet applicable legal guarantees, including reasonable care and skill and fitness for purpose where relevant.
19. Liability
To the maximum extent permitted by law, Zen With Maral is not responsible for losses that:
- were not reasonably foreseeable
- were caused by information or instructions supplied incorrectly by you
- resulted from misuse of a product
- arose from events outside our reasonable control where we took reasonable steps in the circumstances
Nothing in this section excludes or limits liability where doing so would be unlawful.
Nothing in these Terms limits your rights under the Consumer Guarantees Act or Fair Trading Act where those laws apply.
20. Events Outside Reasonable Control
Sometimes an order or service may be delayed by circumstances outside our reasonable control, such as severe weather, transport disruption, natural disasters, supplier disruption, infrastructure failure or other unexpected events.
Where this happens, we will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.
This section does not remove any remedy or responsibility that applies under New Zealand law.
21. Privacy
Our collection and handling of personal information is described in our Privacy Policy.
Privacy Policy: https://www.zenwithmaral.com/privacy
22. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version published on this page applies from its stated “Last updated” date.
Changes will not retrospectively alter the terms of a completed transaction where doing so would unfairly or unlawfully affect your rights.
Where separate terms have been snapshotted or agreed for a particular transaction or service, those terms remain applicable to that transaction as appropriate.
23. Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
Any dispute will be subject to the applicable New Zealand courts or tribunals, without limiting any right you may have to use a consumer dispute process or other remedy available by law.
